\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Em raz\u00e3o de recente mat\u00e9ria publicada no dia 3\/3\/2021 pelo Campo Grande News e republicada pelo portal CQCS, sob o t\u00edtulo \u201cSeguro habitacional e os direitos dos consumidores<\/em>\u201d, a Federa\u00e7\u00e3o Nacional de Seguros Gerais (FenSeg) presta os seguintes esclarecimentos:<\/p>\n

1)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0O Sistema Financeiro da Habita\u00e7\u00e3o (SFH) e o Seguro Habitacional do SFH (SH\/SFH)<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0O SFH foi criado por meio da Lei n\u00ba 4.380\/1964 que, em seu Artigo 14, previa a obrigatoriedade de contrata\u00e7\u00e3o do SH\/SFH pelos adquirentes de im\u00f3veis financiados pelo SFH. nicialmente, as taxas e a sistem\u00e1tica operacional para o funcionamento do SH\/SFH consideraram o perfil social inerente ao SFH e, ao mesmo tempo, observaram a t\u00e9cnica necess\u00e1ria \u00e0s opera\u00e7\u00f5es de um seguro de mercado.\u00a0<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0No entanto, a a\u00e7\u00e3o reguladora do Estado sempre esteve \u00e0 frente do SH\/SFH, com o objetivo de se evitar, em situa\u00e7\u00f5es conjunturais, maior \u00f4nus para os mutu\u00e1rios, em especial para os cidad\u00e3os de baixa renda. Assim, e diante do conte\u00fado social do SFH, extremamente precioso para o Governo Federal, o custo do custo do SH\/SFH foi ajustado \u00e0 capacidade econ\u00f4mico-financeira do mutu\u00e1rio e \u00e0s caracter\u00edsticas sociais presentes no modelo idealizado para o SFH.<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Assim, os mais familiarizados com o segmento de seguros sabem que no SH\/SFH as seguradoras sempre figuraram como meras prestadoras de servi\u00e7os para o Estado. Tal caracter\u00edstica ficou ainda mais n\u00edtida e cristalina a partir da edi\u00e7\u00e3o do Decreto-Lei n\u00ba 2.476\/1988, convertido na Lei n\u00ba 7.682\/1988, pelo qual o FCVS \u2013 Fundo de Compensa\u00e7\u00e3o de Varia\u00e7\u00f5es Salariais (Fundo P\u00fablico vinculado ao Tesouro Nacional) assumiu a garantia do equil\u00edbrio financeiro das opera\u00e7\u00f5es do SH\/SFH, permanentemente e a n\u00edvel nacional.\u00a0<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Posteriormente, o envolvimento das seguradoras com o SH\/SFH foi bruscamente interrompido em decorr\u00eancia da publica\u00e7\u00e3o da MP n\u00ba 478\/2009. Esta MP extinguiu a Ap\u00f3lice P\u00fablica do SH\/SFH e determinou que os contratos financiados no \u00e2mbito do SFH passassem a contar\u00a0com a cobertura do FCVS.\u00a0Como a MP n\u00ba 478\/2009 perdeu sua validade por n\u00e3o ter sido apreciada pelo Congresso no prazo regimental, foi editada a MP n\u00ba 513\/2010 (convertida na Lei n\u00ba 12.409\/201, pelo qual foi determinado que o FCVS assumisse diretamente\u00a0TODAS<\/strong>\u00a0as opera\u00e7\u00f5es do SH\/SFH.<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Diante do aludidos diplomas legais, verifica-se que as seguradoras sa\u00edram por completo da operacionaliza\u00e7\u00e3o ent\u00e3o extinto SH\/SFH, assumindo a CAIXA, na condi\u00e7\u00e3o de Administradora do FCVS, a execu\u00e7\u00e3o de todas as tarefas at\u00e9 realizadas pelas seguradoras.\u00a0\u00a0<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Em rela\u00e7\u00e3o \u00e0s coberturas de Danos F\u00edsicos aos Im\u00f3veis, enfatize-se que a extinta Ap\u00f3lice P\u00fablica do SH\/SFH cobria, apenas, os sinistros decorrentes de Inc\u00eandio, Raio, Explos\u00e3o e danos de causa da natureza. No entanto, algumas normas editadas pelo Estado (no caso o BNH \u2013 Banco nacional da Habita\u00e7\u00e3o) \u201cabriram algumas lacunas\u201d na legisla\u00e7\u00e3o, que foram objeto de aproveitamento por escrit\u00f3rios especializados em litigar contra o SH\/SFH e come\u00e7aram a proliferar feitos no judici\u00e1rio de diversos estados da Federa\u00e7\u00e3o, cujo objeto era o pedido de cobertura do SH\/SFH para os alegados sinistros decorrentes de \u201cV\u00edcio de Constru\u00e7\u00e3o\u201d.<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0A t\u00edtulo de informa\u00e7\u00e3o, destaque-se que, em 31 de dezembro de 2020, tramitavam no Judici\u00e1rio de diversos estados 51 mil a\u00e7\u00f5es, com 403 mil autores, aproximadamente. Caso essas demandas tenham desfechos desfavor\u00e1veis ao SH\/SFH os pagamentos das condena\u00e7\u00f5es ser\u00e3o de responsabilidade final do FCVS\/Tesouro Nacional e, ao fim e ao cabo, pagos pela sociedade.<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Ressalte-se que diversos feitos dessa natureza est\u00e3o em fase de instru\u00e7\u00e3o e julgamento no \u00e2mbito do Superior Tribunal Federal (STF), sem, contudo, se ter uma decis\u00e3o definitiva sobre a mat\u00e9ria. Ainda sob a \u00f3tica jur\u00eddica, \u00e9 importante destacar que se tem um importante processo no Supremo Tribunal Federal (RE n\u00ba 827.996\/PR), que versa sobre as a\u00e7\u00f5es contra o SH\/SFH, especificamente quanto \u00e0 compet\u00eancia para seu processamento e julgamento.\u00a0<\/p>\n

2)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Seguro Habitacional em Ap\u00f3lices de Mercado (SH-AM)<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0As ap\u00f3lices do SH-AM sempre existiram e, inicialmente, eram restritas para a inclus\u00e3o de opera\u00e7\u00f5es de financiamento n\u00e3o enquadr\u00e1veis no SH\/SFH. No entanto, com o advento da MP n\u00ba 478\/2009 e da MP n\u00ba 513\/2010, convertida na Lei n\u00ba 12.409\/2011,\u00a0TODAS<\/strong>\u00a0as opera\u00e7\u00f5es de financiamentos imobili\u00e1rios realizadas no Pa\u00eds, com contrata\u00e7\u00e3o de seguro obrigat\u00f3ria por for\u00e7a do previsto no Art. 79 da Lei n\u00ba 11.977\/2009, passaram a ser inclu\u00eddas exclusivamente em ap\u00f3lices da esp\u00e9cie em refer\u00eancia.<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Frise-se que, no ano de 2009, o Conselho Nacional de Seguros Privados (CNSP), por meio da Resolu\u00e7\u00e3o n\u00ba 205, definiu as condi\u00e7\u00f5es m\u00ednimas para as ap\u00f3lices do SH-AM. No tocante \u00e0 cobertura de Danos F\u00edsicos em Im\u00f3veis (DFI), aquele diploma legal, em seu Art. 4\u00ba do Anexo, disp\u00f5e que:\u00a0<\/p>\n

\u201cA cobertura dos riscos de DFI dever\u00e1 observar o previsto nesta Resolu\u00e7\u00e3o e respectiva regulamenta\u00e7\u00e3o e, nos casos omissos, as normas relativas aos seguros de danos.\u201d<\/em><\/p>\n

\u00a7 1\u00ba A cobertura dos riscos a que se refere o caput contemplar\u00e1, no m\u00ednimo, os danos provenientes de:<\/em><\/p>\n

I. inc\u00eandio, raio ou explos\u00e3o;<\/em><\/p>\n

II. vendaval;<\/em><\/p>\n

III. desmoronamento total;<\/em><\/p>\n

IV. desmoronamento parcial, assim entendido a destrui\u00e7\u00e3o ou desabamento de paredes, vigas ou outro elemento estrutural;<\/em><\/p>\n

V. amea\u00e7a de desmoronamento, devidamente comprovada;<\/em><\/p>\n

VI. destelhamento; e<\/em><\/p>\n

VII. inunda\u00e7\u00e3o ou alagamento, ainda que decorrente de chuva<\/em>.\u201d<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Como poder\u00e1 verificado na Resolu\u00e7\u00e3o CNSP n\u00ba 205\/2009, n\u00e3o tem qualquer previs\u00e3o para cobertura de danos em unidades financiadas decorrentes de \u201cV\u00edcios de Constru\u00e7\u00e3o\u201d.\u00a0\u00a0Ademais, as condi\u00e7\u00f5es de\u00a0TODAS<\/strong>\u00a0as ap\u00f3lices aprovadas pelas seguradoras que atuam no SH-AM junto \u00e0 Superintend\u00eancia de Seguros Privados (SUSEP) t\u00eam Cl\u00e1usula de Riscos Exclu\u00eddos, cujo texto, em geral, disp\u00f5e que\u00a0n\u00e3o contam com cobertura do SH-AM os preju\u00edzos decorrentes de defeitos, falhas e v\u00edcios de constru\u00e7\u00e3o, entendendo-se como tais os defeitos resultantes da m\u00e1 execu\u00e7\u00e3o ou desobedi\u00eancia \u00e0s normas constantes do projeto e\/ou infra\u00e7\u00e3o \u00e0s normas t\u00e9cnicas aplic\u00e1veis \u00e0 constru\u00e7\u00e3o civil, inclusive funda\u00e7\u00f5es. Ou seja, as condi\u00e7\u00f5es dos produtos aprovados pelas seguradoras na pela SUSEP, relativamente ao SH-AM, disp\u00f5em,\u00a0de forma n\u00edtida, cristalina e inequ\u00edvoca, que sinistros decorrentes de\u00a0\u201c\u00a0V\u00edcios de Constru\u00e7\u00e3o\u201d\u00a0n\u00e3o contam amparo do seguro (Produto) em quest\u00e3o de nenhuma seguradora atuante nesse segmento.<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00c9 importante frisar, por derradeiro, que as poucas demandas contra o SH-AM, cujo objeto foi pleitear a cobertura de sinistros decorrentes por \u201cV\u00edcios de Constru\u00e7\u00e3o\u201d n\u00e3o prosperaram no \u00e2mbito do judici\u00e1rio, eis que os contratos de seguros firmados entre os mutu\u00e1rios\/segurados e as seguradoras n\u00e3o deixam margem a d\u00favidas de que tal cobertura n\u00e3o est\u00e1 prevista dentre os riscos cobertos e, mais, \u00e9 expressamente exclu\u00edda de cobertura.<\/p>\n

3)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Conclus\u00e3o:<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Diante do exposto, sem entrar no m\u00e9rito de outras falhas menos relevantes que constam da publica\u00e7\u00e3o em tela, bem como a luz da legisla\u00e7\u00e3o vigente e dos fatos que podem ser atestados junto aos tribunais superiores (STJ e STF), verifica-se que\u00a0a cita\u00e7\u00e3o constante na parte final mat\u00e9ria publicada, na qual cita que \u201cAlgumas seguradas se recusam, tamb\u00e9m, realizar a cobertura de v\u00edcios e\/ou defeitos construtivos. Tal fato, por\u00e9m, encontra diverg\u00eancia nos Tribunais, que j\u00e1 se posicionaram favoravelmente ao entendimento de que o Seguro Habitacional deve cobrir os v\u00edcios construtivos, conforme decis\u00e3o recente do Superior Tribunal de Justi\u00e7a<\/em>\u201d, \u00e9, equivocadamente, atribu\u00edda ao \u201cSeguro Habitacional em Ap\u00f3lices de Mercado \u2013 SH-AM<\/em>\u201d quando, na realidade, elas s\u00e3o relativas a contratos vinculados ao SH\/SFH.<\/p>\n

\u00a0Destaque-se que tal falha na reportagem \u00e9 grave e pode induzir os mutu\u00e1rios ao entendimento equivocado de que eles t\u00eam o direito \u00e0 cobertura n\u00e3o prevista na Ap\u00f3lice contratada. Caso eles venham a reclamar sinistros dessa esp\u00e9cie \u00e0s seguradoras ir\u00e3o emitir a negativa de cobertura e tal fato poder\u00e1 ensejar ingressos de diversas a\u00e7\u00f5es sem fundamentos legais, aumentando o volume de processos nos tribunais no Pa\u00eds e contribuindo para a maior demora na solu\u00e7\u00e3o de conflitos mais relevantes e em tramita\u00e7\u00e3o no judici\u00e1rio.<\/p>\n
